The German labor authority have amended the requirements of work permit applications based on the revised posted workers directive of the “equal pay for equal work at the same place”.

Work permit applications for non-EU nationals will now need to include the salary information as to what is paid abroad and/or in Germany.  The employer must ensure that the foreign national matches the equal pay threshold with their gross salary that is paid unconditionally.  Expenses and allowances that are reimbursed or directly paid to the landlord no longer qualify as salary.

Local hire work permit applications will now also require additional information such as details of the following:

  • Collective payment commitments
  • Employment agreements regarding overtime
  • Number of vacation days
